Penalty clauses and work site suspension

Any late payment may result in late payment penalties in accordance with applicable Luxembourg law. RP CONCEPT reserves the right to immediately suspend work until full payment of all outstanding amounts is received.

Collection fees, interest and administrative costs related to a delay may be charged to the client.

Retention of title clause

The materials, equipment and supplies delivered remain the exclusive property of RP CONCEPT until full payment of the corresponding invoices.

Unforeseen circumstances clause and cost variation

In the event of an exceptional increase in the cost of materials, energy, transport or regulatory constraints, RP CONCEPT may propose a reasonable price revision in order to preserve the economic balance of the contract.

Insurance and liability limits

RP CONCEPT declares that it is covered by professional liability insurance appropriate to its activity.

RP CONCEPT’s total liability shall not exceed the amount excluding VAT actually invoiced to the client for the services concerned.

Tacit acceptance of the work

In the absence of written reservations formulated within a reasonable time after the completion of the work or in the event of occupation/use of the works, acceptance may be considered as tacitly acquired.
